This cemetery is a fine example of the regions long history of pioneers and ranchers. What would Apple Hill California be without its very own pioneer cemetery. During the gold rush which went full force in the 1850s many brave pioneers went into the sierra wilderness to form lives. Some of these people raised cattle while others ran large orchards. At the time in and around 1857's the state of California authorized for the State Wagon Road to be built. This road would run from the Carson Ranges Genoa Peak region all the way up to the town of Placerville California. Some of you are well aware that the route would be called "The Pony Express" which was also a major postal route.

Just as early pioneers traversed the high sierras to make it to Nevada to mine others would be traversing deeper on into California. Thus many new roadhouses and inns emerged along this new road. One of them to emerge is the Nine Mile House and Tavern. This one however was very unique in the fact that by 1887 the Federal Land Patent was granted to a Thomas Hartwick which came with 160 acres of land.

His Inn was part of a smaller village transpiring as a barn, stables, blacksmith, general store and other nearby establishments were built nearby. Those that traversed the wagon road could break bread here and bunk up for the night. Even today many of the small villages in the sierras started off with a house of some sorts. The Nine Mile house symbolized as beacon of hope as those came off of the high sierras from a tiring journey. You might per say have a few proprietors operating in the same site just some might run a small shop or trade.

The cemetery you see in this project was erected prior to the 1900's. Thomas Hartwick wanted to make it a private cemetery since the Hartwicks do dominate over other family names here. He never would get control over it since the state set aside this land for public use. The cemetery was thought of as a civil entity thus it would be the public who would control it at the time. The Nine Mile House may have been owned by Hartwick but being the cemetery was in unincorporated territory the county and board of supervisors overseen it. State law had already precluded any private ownership of the cemetery. They said since it was not licensed to the state the state had no jurisdiction to regulate who uses it. So when you stroll through the cemetery such as the photos and videos you will see many various family names. Fights over who would take ownership of the cemetery did ensue over ownership for many years including in 1939. The County declared that the public acquired a legal title to the cemetery through the law so that the burial ground could be used as such.

In 1965 Thomas Hartwick's son Reverend Charles Hartwick went to Dr. Harold Mozar the health officer for El Dorado County. He asked that the cemetery be transferred in his ownership rather then the county. The board of supervisors authorized a survey and directed the county surveyor to perform it. At the time there was no previous private deeds for the cemetery and thus no legal description of the cemetery parcel every existed. The supervisors denied the Hartwicks after they realized they could not find a copy of the original survey and cannot confirm one ever took place. He was denied ownership of the cemetery all the way till 1975. That year the Public Works Dept. was performing a county-wide survey of cemeteries. That year the Reverend contacted the county and in return they suggested that the cemetery should be given to a local church group. The county did not investigate deeper to find out of Rev. Hartwick had any legal interest in the cemetery. Which he did have considering his ancestors were responsible for the operation of the Nine Mile House which sat a matter of feet from the cemetery. If the county reviewed the entire law they would have seen that the public is who held the title to the cemetery and thus could have been signed over to Hartwick.

So when you pull into the cemetery there is a sign it says Hartwick Hill. As soon as you pull up to the cemetery you will see a chained off family plot which is many members of the Hartwick family. Some have stated that there are two cemeteries one where the public is buried and the other being the Hartwick family plot. As a matter in fact the cemetery is a bit out of control. Nobody knows how many burials have taken place here. Some of the graves are not marked and homes surround the entire cemetery. It continues to be overgrown and nature is consuming everything.

In 1996 the El Dorado County Pioneer Cemeteries Commission alleged to the county of El Dorado that the public had acquired a legal title to the Nine Mile House Cemetery. The problem is that the cemetery is now being operated unlawfully as anybody then could have obtained a title for the cemetery. The party operating the cemetery is not licensed by the state to operate it and has not followed state law relative to private cemeteries thus the county should take over it. Thus it is the public who will remain in control of it according to records. The current operators are deriving incomes from the continuous sale of grave plots on land owned by the public. Thus where those plot sales would go towards the constant care, security and maintenance of the cemetery are being pocketed. Which then leads to higher risk of vandalism and storm damage at any possible moment. If anotherwards your gravestone gets stolen nothing is going to be done about it. Its a sad situation however the county is refusing to take over since its current owner is operating it like a private venue even if it does violate state and county cemetery codes.

Operators generally will never walk away from a cemetery till its filled over the overfill it because they turn death into a cash cow rather then use that funding to properly care for these interments. The county will not take the cemetery because after it was surveyed and studied it was found that the public owned it. As far as who owns it now I heard the Larsen's of the Larsen Ranch in Apple Hill. Burial here still continues on as the cemetery when from a gold rush pioneer graveyard to a place where most of the Apple Hill California ranchers go after death. Many of the well known historic ranches all have family members buried here. Sadly not every grave is visible and the cemetery is not being kept up. Allot of work needs to be gone here and there are no past records of who was buried here in the 1800's many which were the regions first pioneers.

As far as it being haunted well one thing is for sure day or night one EVP and a few mild readings at least show us that its quite possible. You sometimes wonder what it would be like to be a resident and have the cemetery in your backyard. You see all the large overgrown trees which shade the entire cemetery and every gravesite will tell you a story. I mean can you imagine owning a tavern and just a matter of a few feet away pioneers who got sick or died would be buried here! So its definitely historical and resides near the historic town of Camino today. The cemetery has underwent many names of the years all the way from Hartwick, Camino, Crystal Springs, Hamilton and its original name called the Nine Mile House Cemetery. Depending locally on who you talk too all have a different name for the cemetery.

It is amazing that all because of a law that went into effect in 1872 [See former Political Code Sec. 3105 (Stats. 1872).**] Which declared the cemetery as a public entity attributing to the fact that currently it is not more well preserved given its history being the burial ground that stood along the old Pony Express. Its amazing that various families have fought over ownership but then once someone decides to take over it that burials continue to occur but the rest of the cemetery gets neglected. This is why we went here not just to look for ghost but to reveal the intriguing history and how greed has transformed this place of the dearly departed that you see today!

The Nine Mile House stood for more then just a tavern it was the grounds for this very cemetery. One that has been pulled left and to the right for over a century and still today remains in a state of limbo over who should be caring for it. I believe the cemetery should have been deeded to the Hartwick's but that is my opinion and from reading this you may form your own. Just as whether you perceive this place to be a haunted location or you might be like me who just appreciates its historical relevance to the region as it transformed into a ranching empire in Northern California!
